Panda Express in San Jose sued for national origin discrimination

A national origin discrimination lawsuit was recently filed in the U.S. District Court in San Jose alleging the Panda Express restaurant on El Paseo de Saratoga discriminates against Latino employees and favored Asian employees.

The company, based in Rosemead, does have a discrimination policy but “there was a failure to implement it,” according to the Equal Employment Opportunity Commission’s San Francisco District Director.

The lawsuit states that managers at the fast-food restaurant made Latino workers clean but not Asian workers, gave Latino workers other less-desirable tasks than Asian employees, and gave Latino workers fewer hours than Asian workers.

One Latino Panda Express employee stated, “I felt so ashamed when the Asian workers watched me obediently run from the bathrooms to the tables to the counters, cleaning when they did not have to.”
