Breach of Contract Lawsuit Against Powerball Winner Can Proceed

A judge Tuesday denied a motion to dismiss a breach of contract lawsuit against a Vale man who won a 2009 Powerball jackpot.

According to court documents, 4th Circuit Judge John Bastion denied a motion to dismiss the breach of contract lawsuit against a Vale rancher and lottery winner Neal Wanless. Attorney William Van Camp, of Pierre, sought to dismiss the lawsuit on grounds that there was no contract with Tyler Thompson’s Piedmont fencing company to install a certain amount of fence.

Thompson’s attorney, Murl Woods, of Rapid City, claimed that the filing of the lawsuit satisfied the law’s requirement to begin legal action.

In his decision, Judge Bastian said that a motion to dismiss the case at this point in time is a matter of law and not a question of any facts alleged in a lawsuit.
